Cornerstones of national human rights protection mechanisms, Human Rights Commissions and similar institutions find their official international recognition through accreditation by the International Coordinating Committee of National Human Rights Institutions (ICC) working under the auspices of the OHCHR. To receive the accreditation of National Human Rights Institution (NHRI) these Commissions have to be assessed as being in compliance with an agreed set of norms commonly referred to as the Paris Principles. Mozambique is one of the few Countries in the African Continent that does not possess a functioning NHRI yet. However, its establishment is considered a priority by the current Government and reference to the importance of this tool was made both in the draft Plano Nacional de Protecção e Promoção dos Direitos Humanos (PNPDH) and in the Government submission drafted for the UPR process. The adoption of Law nº 33/2009 on 22 December 2009, considered Paris-Principles-compliant, created the Comissão Nacional dos Direitos Humanos (hereinafter CNDH) with a mandate to:
The CNDH will be an autonomous Institution reporting on an annual basis to the President of the Republic and the National Assembly on the situation of Human Rights in Mozambique. With the entering into force of the Law in April 2010, the Ministry of Justice was mandated to work on establishing the CNDH and making it operational. All 11 Commisioners have been selected and are expected to take the oath in July 2012 With the Commissioners in place the new Institution would be able, in theory, to start implementing its mandate from September-October 2012. The Ministry of Justice of Mozambique and UNDP concur with the need to clearly identify the needs of the new Institution to be able to ensure that adequate budget allocations are made for the State Budget of 2013 onwards.
